TERMS

  1. These general Terms and Conditions -Terms and Conditions or “T&C”- shall be valid for all lottery games presented by Lullingstone Games which is registered with the Corporate Affairs Commission of Nigeria and the Nigeria Lottery Regulatory Commission. All lottery games that are available through Lullingstone Games can be accessed through various outlets including but not limited to, online through our website www.lullingstonegames.ng and via several POS outlets. These are hereinafter referred to as ‘the service”.
  2. By using the service, you agree to all of our terms and conditions including website advertising and rules of the lottery games. All the terms and conditions listed herein, shall together be referred to as “the Terms of Use”. “User” and “Customer”, “You” and “Your” refers to you, the person accessing the Service and accepting the Company’s terms and conditions. Whenever the Customer uses the service, such as to place a lottery bet or to participate in any of the promotions offered, he/she agrees to be bound by the Terms of Use, including any amendment which may periodically take place.
  3. The Terms and Conditions contained herein represent the absolute agreement between the Customer and Lullingstone Games and supersede all prior agreements, representations, and understandings.

    INTELLECTUAL PROPERTY
  4. All lottery games present on our website or through various outlets, have been formulated and developed by Lullingstone Games and, shall remain her property at all times.
  5. At any time it deems fit, Lullingstone Games reserves the right to introduce new lottery games for the consumption of its customers and the rules guiding such games shall be circulated on the Lullingstone Games’ website or via other media.
  6. All Trademarks, Domains, Terms of Use, Logos, Images and any other material used by or in Lullingstone Games’ website and products as well as any other content or underlying idea that can be found within our Website, are owned by Lullingstone Games. We will take legal action if this is contravened.

    LIABILITY FOR LOSS OR DAMAGE
  7. Lullingstone Games reserves the right to modify or withdraw an existing game by giving one week’s notice to its customers. Such notice shall be displayed on our website. Lullingstone Games shall not be held liable in any way for any loss or damage by the customer.
  8. Lullingstone Games shall not be held liable in any case for any damage or loss caused directly or indirectly by the service or by its contents or by the contents provided by a third party, unless they are based on intentional or gross negligence.
  9. All lottery games presented by Lullingstone Games are based entirely on probabilities and chance; as a result, Lullingstone Games makes and/or gives no assurances and none is implied, as to the certainty of a win.
  10. Lullingstone Games shall not be liable if the Customer is unable to place a bet due to administrative, software or any other electronic communication media used for the purposes of playing our lottery games.

    AGE OF CUSTOMERS
  11. All customers must be 18 years and above to play all lottery games presented by Lullingstone Games. Lullingstone Games reserves the right to verify its Customer’s stated age and if such age cannot be sufficiently verified, or there are grounds to believe that such customer is below 18 years; such customers will not be permitted to participate in Lullingstone Games services; all accounts belonging to such individual will be closed and any winning(s) shall be forfeited.

    REFUND

  12. Lullingstone Games will not refund any money to any customer once the customer receives evidence like paper ticket, SMS or email notification of playing any of the games. Refunds may be executed if evidence of game played was not generated by Lullingstone Games due to technical flaws and funds were withdrawn from such player’s account

    RESTRICTIONS
  13. All lottery games presented by Lullingstone Games is for personal use and entertainment by the customer and not for commercial use.
  14. Lullingstone Games website is for personal use only and should not be used in any other manner. If a customer uses the website in ways other than for personal use, Lullingstone Games cannot be held liable.
  15. All lottery games presented by Lullingstone Games are time-specific and runs from Monday to Saturday with two draws each day at 12 noon and 5pm West African Time. Lullingstone Games cannot guarantee that draws will commence at exactly 12 noon, but all effort will be made to do so; but it can guarantee that draws will be done no more than 2 hours at the end of play time except for extenuating circumstances that are beyond our control. Customers can determine which game(s) they which to be entered for and for what date up to 7 days in advance. Any game played after 5pm will be deemed to be for the next day except the customer specifies his/her wishes.
  16. Lullingstone Games reserves the right to limit or to refuse customer playing any of our lotto games.
  17. Lullingstone Games reserves the right to restrict access to certain parts of, and services provided, in our Website.
  18. Customers and indeed, all users of our website are prohibited from carrying out any activity that may interfere with the smooth and normal functioning of our website. We may take legal action in such circumstances. 

    PROOF OF IDENTIFICATION
  19. Winners of Lullingstone Games shall be required to provide adequate proof of identification before any winning prize can be paid e.g. International passport, Permanent voter’s card, Driver’s license, or National identity card or as well proof of their mobile phone registered on our database.

    PROOF OF EVIDENCE OF TICKETS.

  20. Winners of Lullingstone Games shall be required to provide proof of play e. g paper ticket, email notification or SMS before any winning prize can be paid.
  21. It is the responsibility of every player to keep evidence of Lullingstone Games played safe and in good condition. Any alteration, defacing or otherwise, tempering with such evidence of game played, shall render such evidence and any winnings if any, null and void.

    CLAIM OF WINNINGS
  22. Winners of Lullingstone Games can claim their winnings of up to N5000 from our approved agents. Any winning above N5000 can only be redeemed by calling the head office. No winnings can be claimed upon the expiration of a period of 180 days following any lottery draw as provided by the National Lottery Act 2005. Lullingstone Games winning prizes shall not be assignable to any person or persons except as provided by the National Lottery (Amendment) Regulations, 2007.

    TERRITORIAL LIMIT
  23. Lullingstone Games can only be played by customers in Nigeria only and payable only in Nigerian Naira.

    USE OF CUSTOMER’S DATA & INFORMATION

  24. The Customer agrees that Lullingstone Games may use his/her personal information including but not limited to name, email address, telephone number, address of residence and/or the image of the Customer for publicity and or promotion. Lullingstone Games may contact you to provide these data and funds for the customer’s winnings may be temporarily withheld until such time the requested data has been received. Lullingstone Games would explore every reasonable avenue available eg telephone calls, text messages and email to contact winners.

    APPLICABLE RULES

  25. Lullingstone Games shall be played in accordance with the advertised rules on our website.
  26. Neither Lullingstone Games nor any of its agents, partners or the Regulatory Agency shall be liable to indemnify any player who fails, neglects or refuses to follow the instructions regarding the playing of Lullingstone Games.
  27. All players’ inquiries must be directed to the approved and advertised channels for quick resolution.

    SERVICE TERMS OF USE MODIFICATION
  28. Any exception to the existing Terms of Use will be communicated in a written form to the Customer. Any verbal statement made by Lullingstone Games employees or affiliates will not be considered in case of a dispute.
  29. This Statement of Rights and Responsibilities (“Statement,” “Terms,” or “SRR”) is our terms of service that governs our relationship with customers and others who interact with Lullingstone Games. By using or accessing Lullingstone Games, the customer or anyone, agrees to this Statement, as updated from time to time.
  30. Lullingstone Games can amend its Terms of Use at any time and at its own discretion. All changes will become effective upon their publication on our website. If you consider any such amendment to our Terms of Use unacceptable, you may stop using our services.
  31. The customer will be deemed to have accepted the amended Term of Use, irrespective of whether or not he/she has acknowledged such changes, if such customer continues to the services of Lullingstone Games.

    MANAGEMENT AND SAFETY

  33. To have access to services and products offered by Lullingstone Games, all customers must open a personal Account either online or by registering their details with an approved agent.
  34. The customer shall not provide any false personal information to our agents or on Lullingstone Games website; or create an account for anyone other than yourself without permission.
  35. It is the responsibility of the customer to keep their details including contact information, accurate always. Such personal data include but not limited to address, telephone numbers and emails. Lullingstone Games reserves the right to close the Account when the information provided is deemed to be false or inaccurate.

    LULLINGSTONE GAMES’S CUSTOMERS ACCOUNT
  36. No customer is permitted to open more than one personal account with Lullingstone Games.
  37. All customers’ personal data are stored in the database of Lullingstone Games and will not be passed on to third parties unless in accordance with the terms set out in the Privacy Policy Section. Lullingstone Games reserves the right to send data of anyone suspected of contravening these Terms to the relevant authorities which deals with the investigation of offences concerning games or price manipulation.   38. If a customer’s account is closed or disabled, such customer cannot create another account without the express written permission of Lullingstone Games.
  39. Customers are prohibited from buying, selling or using someone else’s account in any form including funds. Customers are also prohibited from transferring their account to someone else in any form including funds.
  40. Customers are prohibited from using their personal account or any materials from Lullingstone Games website for commercial gains.
  41. Customers of Lullingstone Games can only open one account. If Lullingstone Games have reasonable grounds to suspect that a customer has opened more than one accounts under his/her name or under different or fictitious names; we have the right to close all accounts and hence, all transactions, relating to such customer.

    SECURITY OF CUSTOMERS’ ACCOUNT
  42. It is the responsibility of the customer to keep his/her password/username or indeed, any other details relating to his/her account safe. Lullingstone Games will treat any transaction on our system as valid if the correct identifying information is entered whether or not it was entered by the customer. Lullingstone Games cannot be held liable for any loss by the customer.
  43. A customer can close his/her account at any point without prior notice to Lullingstone Games. For online account customers, you can close your account on your account page on our website. For other customers, you can call the head office or talk to one of our agents to request for account closure. For our records only and for the benefit of training our staff, you may be asked for reasons for the closure of your account, but you do not have to supply such information if you do not want to do so.
  44. A customer who closed his/her account, can at his/her own discretion re-open such account without prior notice either online on our website or by calling the head office or by visiting an approved agent. Once account is re-opened, customers are subject to the existing Terms of Use.
  45. If and when a customer closes his/her account held with Lullingstone Games; arrangement will be made to transfer all outstanding money in their account after verification of their identity, into the bank account used to open the account.
  46. All customer details will be held securely in Lullingstone Games data base or server for a minimum period of seven years. If a customer wishes to delete his/her details permanently, he/she can do so in writing.
  47. Lullingstone Games retains the right to close account of its customers and exclude such from its services at its discretion. If this happens, arrangement will be made to transfer all outstanding money in their account after verification of their identity, into the bank account used to open the account.
  48. If the account has been closed due to an infringement pursuant to the Terms of Use or to a prohibited behaviour leading to collusion, Fraud or whatsoever Criminal Activity, Lullingstone Games retains the right not to pay any outstanding money in the customer’s account. The same procedure will be applied to any current bet that result in winnings.

    DEPOSITS AND WITHDRAWALS
  49. Lullingstone Games customers can add money unto their account by a variety of payment methods as stated on their account on our website.
  50. Customers can also change their payment methods in their account, but this is subject to appropriate checks by Lullingstone Games.
  51. Customers can also withdraw money from their account outstanding balance as long as such request is into the same payment method used earlier to open the account. Minimum withdrawal value is N500.
  52. Lullingstone Games will require customers who wish to withdraw money from their account, to provide suitable proof of ID.
  53. In order to perform any transaction, Lullingstone Games may undertake any such verification checks as may be required by ourselves or by third parties (including, but not limited to, regulatory bodies) to confirm the legal ownership and the origin of the money, the identity of the applicant and to comply with the relevant Anti Money Laundering Provisions.
  54. Funds deposited in the customer’s account, as well as winnings or other amounts not yet credited, shall not attract any interest.
  55. Lullingstone Games will hold the funds deposited in the customer’s account as trustee for the Customer and not as his/her banker or debtor. Accordingly, there will be no obligation on the part of Lullingstone Games to repay money to the Customer as his/her debtor.
  56. Lullingstone Games will process all eligible winnings for payment the next working day. All efforts will be made by Lullingstone Games to transfer such winning funds to their respective winners, but guarantee cannot be made as to when the funds will get to your account as this is subject to different bank procedures.

    YOUR INFORMATION AND USING OUR WEBSITE
  57. When you delete your account or IP content, it will no longer to seen by others. Lullingstone Games server keeps a back up copy of your account for a reasonable period.
  58. Lullingstone Games website uses cookies, by continuing using our website, you agree for your details including your game choices, to be stored.
  59. Lullingstone Games website may store your payment cards records of the transactions and plays made in your accounts page for your reference. This is designed to show you your previous numbers for ease of playing should you wish to replay them.
  60. Lullingstone Games may at its own discretion, and without previous notice, remove or amend any service(s) and/or prices offered via the Website. However, any game already played will not be affected in such circumstances.
  61. Lullingstone Games will take all necessary steps to ensure that all information provided are accurate and up to date, but we assume no liability for any of such information on our website.

    PROMOTIONS
  62. Lullingstone Games can from time to time, and at its sole discretion, introduce promotions as incentives to customers. Lullingstone Games also can withdraw such promotions without notice. Acceptance of such promotion is an acceptance of any additional terms and conditions associated with the promotions.

    SEVERABILITY
  63. If any provision of these Terms and Conditions is found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of Lullingstone Games Terms and Conditions which shall remain in full force and effect. In such instances, the part declared invalid or unenforceable shall be amended in a manner consistent with the applicable law to reflect, as closely as possible, Lullingstone Games’ original intent.

    TECHNICAL UPGRADE
  64. In the event of an error occurring during or after a technical upgrade of the Lullingstone Games website, such error or occurrence shall be regarded as an act of God and the Company shall be exempted from any liability arising from the technical error.

    GOVERNING LAW
  65. Any dispute arising or in any way connected with these terms and conditions, shall be subject to Nigerian Law and Nigerian Courts shall have jurisdiction after parties have approached an arbitrator and unable to resolve the dispute(s).
